ContentsDeal Terms of Service

Chapter 1. General Provisions
Article 1. Purpose

These terms and conditions define the rights, responsibilities, and other essential articles existing between CONTENTS DEAL PTE. LTD. (“ContentsDeal” hereinafter) and the user regarding the terms of the use in the provision of “ContentsDeal,” a platform that provides digital asset trading to users coordinated under Singapore, where the service is based, to members of the service, who are defined as those who have registered for the ContentsDeal website service. All service contents may be provided in various languages for the convenience of users.

Article 2. Specification and Revision of Terms and Conditions
  • 1. The contents of these terms and conditions will become effective upon notification to the user upon signing up for the ContentsDeal website via website post or miscellaneous methods and the user agrees with these terms and conditions upon registration.
  • 2. ContentsDeal may revise these terms and conditions so long as the provisions stipulated in the “Regulation of Standardized Contracts Act” and the “Act on the Promotion of Information and Communications Network Utilization and Information Protection, etc.” are not violated.
  • 3. In the event that ContentsDeal revises the terms and conditions, the revision date and reason will be specified, and the revised terms and conditions will be posted on the main page of the ContentsDeal website or will be notified to members along with the current terms and conditions for a duration of 7 days before revision date to 7 days after revision, at minimum. The revised item will also be sent to registered members via e-mail. However, in the event that a change to the terms and conditions is important and/or disruptive, the change will be notified to members 30 days before the date of application. Regardless of whether the e-mail has been confirmed by the member, ContentsDeal will have fulfilled its obligation by sending information to the e-mail address specified during registration.
  • 4. In the event that a member’s explicit refusal to revised terms and conditions is absent until one day before the changes take effect and notification has been given, the member’s agreement to the changed provisions will be automatically assumed by ContentsDeal.
  • 5. In the event that a member explicitly expresses disagreement to the revised terms and conditions according to the previous clause, the items in the revised terms and conditions will not be applied and the member may terminate the service contract. However, if the member wishes to continue using ContentsDeal without terminating the service contract, ContentsDeal reserves the right to terminate the service contract with the member if there is a particular reason that the previous terms and conditions cannot be maintained.
Article 3. Items Outside of Terms and Conditions
  • 1. Items not defined in these terms and conditions and the interpretation of this terms and conditions are in accordance with the Act on the Consumer Protection in Electronic Commerce, etc., Regulation of Standardized Contracts Act, Guidelines for Consumer Protection in Electronic Commerce, etc. established by Fair Trade Commission and general legal commercial practices. However, member ContentsDeal transactions will be held in strict compliance with the Door to Door Sales Act, Framework Act on Electronic Commerce, Consumer Protection Act, etc., and members may not claim exemption by quoting the terms and conditions. It is the responsibility of the user to abide by local laws in relation to the legal usage of Contentsdeal in their local jurisdiction
  • 2. In the event of a separate notification, individual term and condition, individual agreement, use guidelines, operation policy or detailed instruction established for the convenience in member transactions, the terms in said article will be followed to the extent that the laws specified in this terms and conditions and in the previous clause are not violated. The related guidelines may be changed and revised according to corporate circumstance to the extent that the terms and conditions and the laws specified in the previous clause are not violated.
Article 4. Definition of Terms

The terms used in the terms and conditions are defined as follows:

  • (1) User: Members and nonmember who engage with the ContentsDeal service.
  • (2) Member: User who consents to terms and conditions, completes registration, and signs a service contract with ContentsDeal to use the ContentsDeal service. One member is recognized per ID.
  • (3) Nonmember: ContentsDeal service user who has not completed user registration.
  • (4) Registration: Electronic/paper application process required for the use of ContentsDeal and the associated authentication procedure.
  • (5) Authentication: Member identification procedure held via e-mail, a mobile phone, address information, OTP, or face ID to use additional services such as the purchase and sales of the contents.
  • (6) ID: E-mail address entered by the member at the time of registration for ContentsDeal service use.
  • (7) Password [PW]: Combination of characters and numbers entered by the member and approved by ContentsDeal to confirm member identity and protect member information.
  • (8) ContentsDeal: Corporation that provides ContentsDeal website service.
  • (9) Website: On-line space established by ContentsDeal for service provision.
  • (10) DEAL: Content token that decentralizes and stores service and customer data and transaction data.
  • (11) Content(s): Digital information provided over on-line communication networks, including music, Webtoons (internet comics), photos, e-book, videos, etc.
  • (12) Cryptocurrency (virtual currency): Unit developed and distributed using block chain technology and electronic display records referred to as KST or tokens.
  • (13) Creator: Content creator and provider, including agencies, artists, composers/lyric writers, web cartoonists, PD, etc.
  • (14) Initial buyer: Member who posts a price to the service and receives content for the first time.
  • (15) Buyer: Member who exchanges the value of the content registered for exchange on the website at the price that has been formed in the market.
Chapter 2. Service Use Application and Acceptance
Article 5. Establishment of Service Contract
  • 1. User will express intent to agree to the terms and conditions after filling in member information fields according to the ContentsDeal registration form, and upon completion of registration, the member’s agreement to the terms and conditions is accepted.
  • 2. Registration is completed on an ID basis. The ContentsDeal website service contract is established according to registration and finalizes the registration process. However, if a member does not comply with necessary procedures requested by ContentsDeal, service usage limitations may arise.
  • 3. Registration using a fake name or with stolen personal information including name or telephone number is not protected by law and the user is legally liable for all pursuant criminal and civil charges.
  • 4. Users under the age of 19 may not register for the ContentsDeal website. In the event that a member registers through a method stated in clause 3, ContentsDeal may retract approval or suspend membership, and ContentsDeal will not be held responsible for any resulting damages. The member will be held solely responsible for all pursuant criminal and civil cases.
  • 5. In accordance to clause 1, ContentsDeal may request real name and ID verification through a specialized institution based on the user according to pertinent law. ContentsDeal will not be held responsible for any damages that may occur due to verification failure when ContentsDeal request has been refused.
  • 6. Corporations may register and use the ContentsDeal service once separate documents and procedures additionally requested by ContentsDeal on top of the existing procedures provided by the website to verify the corporation, corporation intent, and corporation intention. Services and items that are not defined separately comply with general membership rules.
  • 7. Service use may be restricted if the user is a citizen, permanent resident or resident of a country that the Financial Action Task Force (FATF) has designated as a blacklisted country for money laundering and members must guarantee the following:
    • (1) User is not be a citizen, permanent resident, or resident of a blacklisted country.
    • (2) Service will not be used while staying in a blacklisted country.
Article 6. Application for Use
  • 1. Application for use is enacted once the user completes the form ContentsDeal requires for registration.
  • 2. User information pertaining to the above clause 1 is regarded as real data and users or member who registered with falsified data is not protected by law and may be barred from using the service.
  • 3. In the event that incorrect or falsified information is entered or such information is discovered at a later time, ContentsDeal has a right to temporarily suspend use of service, permanently suspend the member, or terminate the service contract and the member will be responsible for any damages incurred to ContentsDeal or to the pertaining third party.
Article 7. Member Information Agreement and Application of Use Agreement

1. Member Information Use Agreement

  • (1) ContentsDeal uses member personal information for the execution of the service contract and provision of services specified in this service contract.
  • (2) ContentsDeal will not send partnered service advertisements in the case that the member explicitly refuses to receive such advertisements. However, ContentsDeal may send SMS and SMS URL regarding product use and information for partnered service convenience, and the member can delete their account or refuse to accept these communications by sending a request to ContentsDeal.
  • (3) Members can view or edit their personal information at any time.
  • (4) Upon entering user information during the registration process, the user is deemed to have agreed to the collection, use, and provision of member information according to the terms and conditions.

2. Application of Use Consent

  • (1) ContentsDeal registration is approved once the user accurately fills in all of the required items and applies for the use of the service. However, ContentsDeal may delay or deny registration due to terms (2) and (3):

    • (2) Technical limitation
    • (3) Unable to provide service use consent due to other corporations
  • (3) Registration Rejection
    • (1) Falsified name
    • (2) Registration using the name of another person
    • (3) Falsified required fields
    • (4) Registration done with intent to harm or offend
    • (5) Field deemed to be incompatible with service application requirements
Article 8. Suspension and Termination of Service Contract
  • 1. The service contract will be terminated upon nullification by the user or by ContentsDeal. Damages incurred from termination due to account deletion without intent due to ContentsDeal error or negligence is the responsibility of the member in question and ContentsDeal will not be held responsible whatsoever.
  • 2. In the event that a member wishes to terminate the service contract, the member must register through the customer service center and proceed with the intent verification procedure.
  • 3. ContentsDeal reserves the right to set member access restrictions or terminate the service contract if the member in question has taken one of following actions:
    • (1) Stolen or improper use of service ID, password, or personal information
    • (2) Intentional interference in service operation
    • (3) Falsified registered name
    • (4) Intentional distribution of offensive and/or harmful content
    • (5) Member uses or plans to use the service to harm the public interest
    • (6) Defamation or libel
    • (7) Distribution of disruptive and/or destructive malware
    • (8) Copying, distribution, or commercial use of information acquired from ContentsDeal service information without prior consent
    • (9) Violation of ContentsDeal, member, or third party intellectual property
    • (10) Request for correction or administrative guidance by a legal institution or governing administration
    • (11) Violations of terms and conditions or website use conditions
    • (12) User action is suspected or determined to be criminal or in violation of the law
    • (13) User action is suspected or determined to interfere with website operation and/or usage from other users
    • (14) Transmission of a large volume of data for the purpose of interfering with the stable operation of the service or sending advertisements
    • (15) The same user has registered with a different ID
    • (16) Request for correction from an external institution such as the Korea Communications Standards Commission, or the authoritative interpretation is received regarding unlawful campaigning from the National Election Commission
    • (17) Objective determination that member is using service for illegal activity
    • (18) Cryptocurrency trade on behalf of other parties for the purpose of abusing fees
    • (19) Collection, storage, or disclosure of user personal information without user agreement
    • (20) Member action deemed to be illegal
  • 4. In the event that ContentsDeal intends to restrict or suspend the use of a member, ContentsDeal will notify the member or their legal representative through a letter, a communication network (e.g., phone), or on-line communication method such as e-mail, after determination of the reason, date and time, and the period. However, if ContentsDeal determines that there is a need to urgently suspend the member, the member may be restricted or suspended without prior notice, and details of this will be notified to the user within 2 business days afterward.
  • 5. Restricted or suspended members may send an appeal to ContentsDeal, and ContentsDeal can review the appropriateness of the appeal by requesting or checking additional data or evidence. ContentsDeal will lift the restriction or suspension within 2 business days once ContentsDeal has verified that the reason for restriction or suspension has been resolved or deemed to be inappropriate.
  • 6. In the event that a member has been suspended or restricted twice or more, or resolution to action prompting repudiation has not been provided within 30 days of repudiation, ContentsDeal may terminate the member’s service contract and send a notification to the member using the notification method described in clause 4.
  • 7. In the event that ContentsDeal terminates the service contract, though the member’s registration will be deleted in principle, to prevent a member whose account has been deleted due to violation of the terms of use from rejoining, some personal information will be stored after several encryptions so that the restricted users may be identified.
  • 8. In the event that customer information is deleted due to termination of the contract or account deletion, only member information will be deleted, and the posts made by the member on the ContentsDeal website will not be deleted together due to termination of the contract or account deletion.
Article 9. Revision of Member Information
  • 1. Members can view and revise their personal information at any time through the website “edit personal information” menu. However, name, date of birth, gender, and ID cannot be edited due to service management purposes.
  • 2. The member must correct the personal information on-line or notify ContentsDeal through e-mail or message if there is any change in information entered when the member signed up.
  • 3. ContentsDeal will not be held responsible for damages incurred due to failure to notify ContentsDeal of changes in the above clause 2.
Chapter 3. Member Responsibility
Article 10. Managing ID and Password
  • 1. Aside from circumstances in which user ID and password is released due to ContentsDeal member information error or negligence, the responsibility of ID and password management belongs entirely to the member. The member is responsible for all results that may arise from the inappropriate management of ID and password and improper use.
  • 2. Upon becoming aware that their ID is being used improperly, the member must immediately notify ContentsDeal and follow ContentsDeal instruction.
  • 3. In the event of the above clause 2, ContentsDeal will not be held responsible for the damages incurred from the member failing to notify ContentsDeal or does not follow ContentsDeal instruction.
Article 11. Provision of Information

ContentsDeal may provide the following service information to members if they are deemed necessary for member service. Members reserve the right to refuse to use these services.

  • 2. Events
  • 3. Miscellaneous ContentsDeal services
Chapter 4. General Provisions for Service Use
Article 12. Service Type
  • 1. Services provided by ContentsDeal are as follows:
    • (1) Cryptocurrency transactions (sale, purchasing, provision of transaction API, market price information inquiry service)
    • (2) Ledger management for the storage and the payment of purchased and sold cryptocurrencies
    • (3) Processing of cryptocurrency withdrawal requests
    • (4) Other cryptocurrency related services
    • (5) Contents (various security functions and additional services, additional partner services for member convenience and cryptocurrency)
    • (6) Dedicated viewer for contents provided by ContentsDeal
  • 2. ContentsDeal uses a separate partnered firm to accurately recognize the purchase of cryptocurrency in KRW needed for sale or cryptocurrency that will be deposited through the procedure determined by ContentsDeal for the management of the transaction ledger and the withdrawal service in items (1), (2), and (3) of clause 1 of this article. ContentsDeal then safely stores this information in blocks or distributes it through the financial institution or the corporation’s storage device. Then, all transaction records will be managed with the ledger (transaction DB) and if a member requests a withdrawal from the exchange, the withdrawn item will be handed over according to the request. However, the request and the processing of the withdrawal may be partly restricted based on business hours and other details.
  • 3. In the event that the information in item (2) of clause 1 of this article is normal, unhacked, uncorrupted and legitimate information compliant with (1), ContentsDeal is required to dispense said amount even if the actual amount of cryptocurrency or Korean Won that ContentsDeal possesses is different from the information of (2) archived by ContentsDeal. However, of the customer agrees to receive miscellaneous compensation from ContentsDeal regarding the previous clause and agrees to correct the information of (2) as it is paid, this obligation may be replaced.
  • 4. The types of services provided by ContentsDeal may be changed due to corporate circumstances situation, in which case members will be notified of changes and provided a sufficient grace period to minimize damages incurred to members. The intellectual property rights for the provided service belong to ContentsDeal.
  • 5. ContentsDeal privileges such as ID, service usage and points, are granted to members according to the condition of use determined by ContentsDeal. Members may not sell their ContentsDeal privileges to a 3rd party, provide the service to others for free, or use these privileges for commercial repurposing.
  • 6. ContentsDeal may assign member grade based on certain conditions, and members may be granted access to or restricted from using certain features accordingly.
Article 13. Service Detail Change and Notification
  • 1. ContentsDeal notifies users of each service’s characteristics, procedure, and method in the ContentsDeal website according to the service type, and members must understand service details before using.
  • 2. If service details have been changed, ContentsDeal must notify users 7 days before said change and send the details of these changes to users via e-mail or SMS. ContentsDeal will not be held responsible for any damages incurred from member failure to view said details.
  • 3. E-mail and SMS in clause 2 of this article is based on information provided during registration and it is the responsibility of the member to ensure that the e-mail address and mobile phone number is valid and can be reached. ContentsDeal will have fulfilled its responsibility to inform users upon sending the corresponding e-mail/SMS.
Article 14. Service Maintenance and Suspension
  • 1. In the absence of server or technical issues, ContentsDeal is available 24 hours a day, 365 days a year unless there is a specific business or technical issue. However, the service may not be available during scheduled maintenance, for which notification will be given.
  • 2. Despite the stipulations of clause 1, the following services may be provided only during a specified operation time:
    • (1) Cryptocurrency deposit and withdrawal
    • (2) Other time of use specification services determined by ContentsDeal to be required for incident prevention, security, and smooth service
  • 3. ContentsDeal reserves the right to suspend the service free from error or negligence in the following cases:
    • (1) Unavoidable facility repairs and construction
    • (2) The key telecommunications service provider specified in the Telecommunications Business Act suspends telecommunication service
    • (3) Third party and/or partnered firm suspends service used in ContentsDeal
    • (4) Other uncontrollable factors in the operation of ContentsDeal
  • 4. ContentsDeal can restrict or suspend all or part of the service when there are service usage issues due to national emergency, power outage, facility failure, or excessive service traffic.
Article 15. Contents Use and Privilege
  • 1. Contents provided by ContentsDeal will be displayed with the appropriate age indicator and certain content may require adult verification.
  • 2. Content provided by ContentsDeal may not be reprocessed or redistributed.
  • 3. Members cannot copy, send, reproduce, or revise contents.
  • 4. Service usage limitations pertaining to contents of partnered firms who provide contents may change, and the reason for change will be notified to members through website notification.
  • 5. Depending on content characteristics, certain contents may have a duration or exclusive period, and the contents may be terminated and the exclusivity lifted once the duration expires.
Article 16. Copyright Ownership
  • 1. Copyright and other intellectual property rights regarding content provided by ContentsDeal belong to partnered firms, ContentsDeal, and the content creator.
  • 2. Members can not use the content protected by ContentsDeal/partner/user intellectual property rights for commercial purposes such as copying, distribution, publishing, broadcasting, and enabling third party use.
  • 3. ContentsDeal is required to notify the member and content creator upon using copyright belonging to said user or creator according to the terms and conditions.
Article 17. Payment Restriction
  • 1. ContentsDeal may limit member payment in the following cases:
    • (1) Abnormal transaction such as hacking or stealing
    • (2) Restriction request from the payment service provider or payment firm
  • 2. In the event of clause 1, ContentsDeal will notify members of the circumstances through website notification or e-mail.
  • 3. Service restriction can be lifted if a site operation administrator or operator requests that the member submits identity verification data and said data is confirmed.
Article 18. Member Deposit and Withdrawal Restrictions
  • 1. To prevent financial incidents and damages from fraud such as voice phishing, ContentsDeal requires that members complete additional identification before allowing access to member cryptocurrency deposit and withdrawal service under the following circumstances. The object to deposit or withdraw is cryptocurrency or electronic currency (prepaid method).
    • (1) Member and depositor name do not match
    • (2) Amount of withdrawals is excessive compare to the number of transactions, leading to hacking, scamming or voice phishing concerns
    • (3) Deposit or withdrawal service is restricted or delayed based on smooth ContentsDeal service provision policy
    • (4) Electronic request information beyond the authority of use defined by ContentsDeal
    • (5) Provision of the information that the account of the member is suspected to be used for illegal activities from national and financial institutions such as police, National Tax Agency, etc.
  • 2. In the event of clause 1, ContentsDeal will notify members of the circumstances through website notification or e-mail.
  • 3. Service use restriction can only be cleared once the condition for clearance is satisfied by submitting identification data requested by the site operation administrator according to ContentsDeal regulation.
Chapter 5. Cryptocurrency Transaction Service Use
Article 19. Cryptocurrency Sale/Purchase Registration
  • 1. In the event that cryptocurrency is sold or purchased through ContentsDeal service, the member must register the transaction according to the registration form provided by ContentsDeal.
  • 2. Until the purchase or the sale is completed according to the related form, intent to sell or purchase can be withdrawn according to the form provided by ContentsDeal at any time. However, if the trade is completed as marked by the completed symbol, the buyer or seller cannot cancel the transaction or demand refund.
  • 3. Use of Supplementary Service
    • (1) Members who wish to sell their cryptocurrency can register for supplementary service during the transaction for more effective sales. Supplementary service details are as determined by ContentsDeal.
    • (2) All cryptocurrency sale/purchase services provided by ContentsDeal to its members is done under the provision of individual member usage for their convenience and external/commerical use is prohibited.
Article 20. Cryptocurrency Storage
  • 1. ContentsDeal safely stores cryptocurrency deposited by users for the purpose of trading through separate and secure technological distribution methods. ContentsDeal records and manages the transaction ledger according to the record traded by customers, and if the customer requests cryptocurrency withdrawal according to the actual record in the ledger, ContentsDeal will send it to the designated address that the customer has requested based on the information that is recorded in the ledger.
  • 2. ContentsDeal will notify users within 30 days in the event that cryptocurrency will be delisted from trade. In the event that ContentsDeal determines that the user will suffer damages from cryptocurrency loss due to ContentsDeal being unable to store a cryptocurrency not withdrawn after notification, ContentsDeal can store it by exchanging it for cash at the current market value.
  • 3. ContentsDeal will inform and notify customers who own delisted cryptocurrency about withdrawal through website notification, e-mail and SMS using the registered member information. Afterward, if the cryptocurrency cannot be exchanged at the previous market price, ContentsDeal will post the appropriate purchase price determined by ContentsDeal and store it after exchanging it at said price.
  • 4. Clause 2’s E-mail and SMS condition is considered fulfilled upon delivery of the e-mail/SMS.

  • 1. ContentsDeal provides an online system allowing for buyers and sellers to trade cryptocurrency and ContentsDeal charges a fee in return. The fee charged by ContentsDeal is in accordance to the rate posted separately on the website.
  • 2. The fee may change according to the situation of ContentsDeal and the market.
  • 3. ContentsDeal may charge a service fee for services such as deposit, withdrawal, or other non-trade services, and payment can be made using the separate payment method.

  • 1. ContentsDeal provides an online system allowing for buyers and sellers to trade cryptocurrency and ContentsDeal charges a fee in return. The fee charged by ContentsDeal is in accordance to the rate posted separately on the website.
  • 2. The fee may change according to the situation of ContentsDeal and the market.
  • 3. ContentsDeal may charge a service fee for services such as deposit, withdrawal, or other non-trade services, and payment can be made using the separate payment method.
Article 23. Non-fee Earnings

Money earned from interest accrued by ContentsDeal in the process of using the ContentsDeal service is treated as compensation for providing cryptocurrency economy service and members have no rights to these earnings.

  • 1. ContentsDeal can provide the following services, and the services provided through partnered services must clearly specify the fact their partnered nature. Defective service and sale responsibilities for partnered service belongs to the service provider of the partnered firm.
    • (1) Authentication security contents
    • (2) Cryptocurrency mining service
    • (3) Electronic prepayment methods
    • (4) Mobile/digital contents such as music, Webtoons, e-Books, video, etc.
  • 2. In the event that ContentsDeal needs to share member information with the partnered ContentsDeal when providing or registering for partnered services, ContentsDeal will ask for agreement to share and providing information due to provision of service, share the minimum necessary information, then provide the service.
Chapter 8. Personal Information Protection
Article 25. Member Information Use Agreement
  • 1. ContentsDeal’s personal information protection policies are in full effect concerning member information. Upon entering user information during the registration process, the user is deemed to have agreed to the collection, use, and provision of member information according to the terms and conditions.
  • 2. The personal information manager will be supervised by a manager separately designated by ContentsDeal.
  • 3. For members to use ContentsDeal or affiliated services efficiently and conveniently, ContentsDeal may use member information or provide it to affiliated firms according to the procedure specified in this contract. However, ContentsDeal will disclose or distribute the information of the member to the third party only after notifying users of the partnered firm, the purpose of provision, and the member information to be provided in advance and permission is granted by the user, except for requests from national institutions according to legal obligations, the framework act on telecommunications, criminal investigation purposes, requests from Korea Internet Safety Commission, or requests according to procedure specified in other laws. However, the limitations of this clause will not be applied when the information from both sides are exchanged or provided based on mutual agreement of both stakeholders according to the process during the transaction between individuals through P2P transaction window between individuals.
  • 4. In the event that personal information provided at the time that the applicant or member signed up has changed, the member must revise the related items through the member information revision window if they have requested the change to ContentsDeal. However, member ID, name, date of birth, and gender cannot be revised for credit management purposes. However, damages incurred due to uncorrected information will be the responsibility of the member, and ContentsDeal will not be held responsible for it at all.
  • 5. If a member has a complaint regarding the handling of the personal information by ContentsDeal, details of the complaint may be submitted through the procedure outlined on the website or through e-mail, and ContentsDeal must process the complaint of the member according to appropriate procedure.
  • 6. According to the provisions in article 8, in the event that the service contract has been terminated, though the member’s registration will be deleted in accordance to the Act on the Consumer Protection in Electronic Commerce, etc., to prevent a member whose account has been deleted due to violation of the terms of use from rejoining, some personal information will be stored after several encryptions so that the restricted users may be identified.
  • 7. ContentsDeal will store the personal information of members for the period specified by related law if commercial or other laws dictate a need for preservation even when ContentsDeal is required to dispose of personal information. However, resident registration numbers will be stored by masking the last 6 digits and encrypting them.
  • 8. In the event that personal information is collected for use of a certain service or must be sent, ContentsDeal must notify the member in advance and receive member agreement. Personal information provided by the member cannot be provided for use outside of the intended purpose without member consent.
Chapter 9. Damage Compensation and Exemption Provisions
Article 26. Damage Compensation

ContentsDeal will not be responsible for any incident that has occurred through transactions non-compliant with transaction rules stipulated in the terms and conditions and for disputes incurred due negligence from the buyer or seller. ContentsDeal does not guarantee the value of cryptocurrency not issued by ContentsDeal nor guarantee payment. Damages incurred by partnered firms will follow the terms and conditions of the partnered firm and will be settled between the partnered firm and the member in question.

Article 27. Exemption Provisions
  • 1. ContentsDeal will not be held responsible or deemed negligent in the following cases:
    • (1) Unavoidable circumstances such as war, incident, natural disaster or equivalent national emergency
    • (2) Damages incurred intentionally or due to user negligence
    • (3) Telecommunication service failure incurred by key telecommunications service provider specified in the Telecommunications Business Act
    • (4) Shut down of a server due to natural disaster, DDos attack, IDC failure, or sudden increase of service access traffic
  • 2. ContentsDeal will not be held responsible for service failure due to user liability.
  • 3. ContentsDeal will not be held responsible for content that the user has posted or sent.
  • 4. ContentsDeal will not be held responsible when a problem occurs in cryptocurrency transmission due to the failure of the cryptocurrency management system, service failure by communication service providers, or scheduled maintenance time. If 3rd party cryptocurrency is acquired or received without authority due to service error, system failure or other reasons, ContentsDeal can take necessary actions such as withdrawing the cryptocurrency after notifying the user or restoring user balance to its original state.
  • 5. ContentsDeal will be exempted from responsibility when a mutual transaction occurs between members or between a member and the third party using the service as a medium.
  • 6. ContentsDeal will not be held responsible or deemed negligent for free services absent of specific regulation.
  • 7. In the event that a member files for damages against ContentsDeal, ContentsDeal may provide the cryptocurrency or electronic currency (prepaid method) compensation to the member’s electronic wallet.
  • 8. ContentsDeal may conduct regular, irregular, or sudden server maintenance for stable service provision. If the price of cryptocurrency of local and international exchanges is abnormally different from the price of the order standby for purchase/sales on the service after the completion of the server checkup, the standby order can be cancelled by ContentsDeal according to the internal policy to protect the member.
Article 27. Exemption Provisions
  • 1. ContentsDeal does not have authority to represent members who wish to sell or purchase cryptocurrency, and any action by ContentsDeal will not be regarded as the representation of a seller or a buyer.
  • 2. Websites that are connected (linked) to ContentsDeal (gift certificate mall, pay-to-view content suppliers, etc.) are partnered companies that have been partnered via contract with ContentsDeal. ContentsDeal only provides partnered companies with connection (link), and they will be held responsible for the operation of their service, sale of products, delivery, and refunds without participation in operations from ContentsDeal.
Article 29. Dispute Settlement
  • 1. ContentsDeal will establish/conduct damage compensation in response to fair opinions and complaints lodged by members and will provide apt compensation.
  • 2. ContentsDeal will process complaints and opinions submitted by members at the highest priority. However, if the issue cannot be handled promptly, the reason for delay and when the issue will be addressed will be notified to the user immediately.
  • 3. If there is a request for the damage compensation by a member regarding an e-commerce dispute between ContentsDeal and the member, it may be settled by accepting the adjustment made by the dispute resolution authority that the Fair Trade Commission or the mayor/governor requests in said case.
Article 30. Court of Jurisdiction and Governing Law
  • 1. The service terms and conditions will be regulated and interpreted according to the law of the Singapore, and if a lawsuit is filed between ContentsDeal and the member regarding the use of the service such as the fee charging structure of ContentsDeal, Singapore law will be applied.
  • 2. In the event that a lawsuit is filed between ContentsDeal and the member regarding service use, the court that is chosen according to the law will be the Singapore governing court.
